Уважаемые, автолюбители, обращаем Ваше внимание на ЗУ, который запрещает банкам в одностороннем порядке изменять проценты по кредитным договорам.

ЗАКОН УКРАЇНИ
Про внесення змін до деяких законодавчих актів України щодо заборони банкам змінювати умови договору банківського вкладу та кредитного договору в односторонньому порядку
Верховна Рада України постановляє:
I. Внести зміни до таких законодавчих актів України:
1. У Цивільному кодексі України (Відомості Верховної Ради України, 2003 р., NN 40 - 44, ст. 356):
1) доповнити статтею 10561 такого змісту:
2) "Стаття 10561. Проценти за кредитним договором
1. Розмір процентів та порядок їх сплати за договором визначаються в договорі залежно від кредитного ризику, наданого забезпечення, попиту і пропозицій, які склалися на кредитному ринку, строку користування кредитом, розміру облікової ставки та інших факторів.
2. Встановлений договором розмір процентів не може бути збільшений банком в односторонньому порядку.
3. Умова договору щодо права банку змінювати розмір процентів в односторонньому порядку є нікчемною";
2) статтю 1061 після частини третьої доповнити новою частиною такого змісту:
"4. Умова договору щодо права банку змінювати розмір процентів на строковий вклад в односторонньому порядку є нікчемною".
У зв'язку з цим частини четверту та п'яту вважати відповідно частинами п'ятою та шостою.
2. Статтю 55 Закону України "Про банки і банківську діяльність" (Відомості Верховної Ради України, 2001 р., N 5 - 6, ст. 30) доповнити частиною четвертою такого змісту:
"Банкам забороняється в односторонньому порядку змінювати умови укладених з клієнтами договорів, зокрема, збільшувати розмір процентної ставки за кредитними договорами або зменшувати її розмір за договорами банківського вкладу (крім вкладу на вимогу), за винятком випадків, встановлених законом".
II. Цей Закон набирає чинності через 10 днів з дня його опублікування.
